  1. ELIGIBILITY: The KLEIN TOOLS “Electrician of the Year” Contest (the “Contest”) is open only to, and both the nominator and the nominee must be, individual, legal residents of the 50 United States and the District of Columbia who are 18 years of age and older. Nominees must be an electrical, HVAC or lineman instructor. Previous winners, both Regional Winners and Grand Prize Winners, are ineligible to participate. Employees, officers and directors of KLEIN TOOLS, INC. (“Sponsor”), ZAH Group, Inc., and each of their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and each such person’s IRS dependents, immediate families (spouse, siblings, children, parents and their respective spouses) and those living in their same households, whether or not related, are not eligible to nominate someone or win a prize. Void where prohibited.
  2. TO ENTER: The Contest begins at 12:00:01 AM CST on August 12th, 2019 and ends at 11:59:59 PM CST on September 29th, 2019 (the “Promotion Period”).

    Nomination:

    Nominate an instructor who has made a difference in your community and is deserving of the “2019 ELECTRICIAN OF THE YEAR” title by visiting www.kleintools. com/hotc or https://www.kleintradesmanclub.com/hotc during the Promotion Period and following the instructions (a “Nomination”). You may nominate yourself. The ELECTRICIAN OF THE YEAR award recognizes someone who has made a difference in the lives of the people they teach as well as their community by mastering their craft, developing an incredible learning environment and community dedication. All Nominations must be received by 11:59:59 PM CST on September 29th, 2019.

    Limit one (1) Nomination per person as nominator. Released Parties (as defined below) are not responsible for late, incomplete or inaccurate Nominations, and all such Nominations will be void. Nominations become the sole property of Klein Tools and none will be returned. Nominations may be made online only. Released Parties are also not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

    Question & Answer:

    Each Nomination must answer three (3) questions stating why you believe your nominated electrician is deserving of the award (“Answers”). The questions will focus on mastering their craft, developing an incredible learning environment and community dedication and answers must be based on actual events and circumstances and must be factually accurate with regard to the nominated instructors background. The Answers must be written in English or Spanish.

    The Answers must be original, created solely by nominator, and once submitted, may not be further edited. The Answers must not have won any other prize or award, must not have been previously published, and must not have been submitted in any other contest, promotional event, or publication at any time. The Answers must not defame, libel, or infringe upon the rights of any third party, including but not limited to any copyrights, trade names, trademarks, property rights, rights of privacy or publicity, or any other rights of any person or entity. Sponsor reserves the right to disqualify in its sole discretion any Nomination it deems to be inappropriate, offensive or not in keeping with Sponsor’s image. Answers that, in the sole opinion of Sponsor, are deemed not to be original or are deemed to be unsuitable for publication will be ineligible. By participating, nominators and, by accepting a prize, prize winners agree to be bound by these Official Rules. A Nomination may be withdrawn in Sponsor’s discretion if a written request for such withdrawal is made by the nominee.

  3. OWNERSHIP/USE: Submission of a Nomination constitutes the nominator’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in the Nomination and the Answers as part of the Nomination, including, without limitation, all copyrights, and the nominator waives all moral rights with respect to the Nomination and the Answers. By submitting a Nomination and Answers, the nominator represents and warrants that (a) the Answers is original work created solely by the nominator and all factual matters set forth therein are true, (b) the Answers does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, (c) use and publication of the Answers by Sponsor will not infringe on the copyrights, trademarks, moral rights, rights of privacy/public or intellectual property rights of any person or entity, (d) the Answers have not previously been and will not in the future be entered in any other contest, and (e) the Answers have not been previously published in any medium. By submitting a Nomination and Answers, the nominator further agrees that Sponsor may exploit, edit, modify, and distribute the Answers and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party.
  4. WINNERS AND PRIZES: Six (6) Regional Winner prizes: One nominee will be selected as a Regional Winner from each of six (6) regions (defined below) and will receive a Klein Tools Ultimate Garage Package, which includes (Tradesman Pro Tough Box Cooler – x1, Tradesman Pro™ Tool Gear Backpack – x1, Beverage Tools – x2, Klein Stools - x2, Contractor’s Clipboard – x1, Wireless Jobsite Speaker – x1, BBQ Tool Set – x1,, Stand-Up Zipper Bags, 2-Pack – x1) and their training center will get $500 in Klein Tools. Guest must agree to be bound by these Official Rules and must sign a release consistent with that set required of Regional Winner in these Official Rules. Approximate Retail Value (“ARV”) of the Regional Prize is one thousand dollars (US $1,000). Regional Winners will be notified by phone, email, and/or overnight mail before October 11th, 2019.

    Region 6: Pennsylvania, Maryland, Delaware, New Jersey, New York, Connecticut, Rhode Island, Massachusetts, Vermont, New Hampshire, Maine

    Each Regional Winner, by acceptance of a prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, photograph, biographical information contained in winning Answers, voice and/or likeness for advertising, trade and promotional purposes without further compensation, at any time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval.

    One (1) National Grand Prize Winner will receive, in addition to the previously awarded regional prize, $1,000 in Klein Tools and $1,000 in cash ARV of the Grand Prize is $2000; ARV of the total award to the National Grand Prize Winner is $3,000. Sponsor is not obligated to notify the nominator that his or her nominee has been selected as a prize winner.

    All Prizes will be awarded to the Regional Winners and the National Grand Prize Winner; nominators will not receive a prize (unless the nominator nominated himself or herself). No substitution, assignment or transfer of prize permitted by winner. Prizes cannot be redeemed for cash, but Sponsor reserves the right to substitute a prize in whole or part with a prize of comparable or greater value, at its sole discretion if an advertised prize becomes unavailable. All federal, state and local taxes and any other costs and expenses associated with the prize are the sole responsibility of each winner, and each winner must complete all forms requested by Sponsor to evidence and accomplish such (“Tax Forms”).
  5. JUDGING: The Sponsor will administer the selection process for the Contest. All decisions regarding the Winners and Prizes will be made by a panel of Sponsor’s management team members, consisting of five (5) members, in their sole judgement. All decisions are final and binding in all judging matters relating to this Contest. Initial nominations to select Regional Winners will be judged on the following equally-weighted criteria: 1) professional achievement, 2) safety excellence and 3) community contribution. Nominations will be judged solely on the basis of information submitted with the Contest Answers.

    Each Regional Winner will be announced and presented on www.kleintools.com/eoy. The public will have a chance to vote for the Regional Winner they think is most deserving based on equally weighted criteria. 1) Professional achievement, 2) safety excellence and 3) community contribution. Eligible entries will be voted on by Klein Tools’ Facebook Fans. Fan voting will be open from 12:01 AM CST on October 14, 2019 until 11:59 PM CST on October 18, 2019 (“Voting Period”) and will be used as part of the criteria to select the final Grand Prize Winner. Entries generated by script, macro or other automated means may be void. Limit one (1) entry per person/e-mail address/authorized Facebook account holder per day during the Voting Period. The use of multiple name variations or other methods to create additional votes by a single individual during any one (1) day period is prohibited.

    All Regional Winners will be judged by a second panel of five (5) judges using the same criteria as original submissions plus fan vote totals on or about October 21, 2019 and the nominee whose Nomination receives the highest score among the six (6) Finalists will be declared the National Grand Prize Winner. Regional Winners will be judged on the following weighted criteria: 1) Master of the Craft (30%), 2) Classroom/Lab Experience (30%), 3) Community Contribution (30%) and 4) Fan Voting (10%).
  6. GENERAL CONDITIONS: All details and other restrictions of any prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. By submitting a Nomination or accepting a prize, as applicable, each nominator and winner agrees to release and hold Sponsor, ZAH Group, Inc., participating retailers, and each of their respective parents, subsidiaries and affiliated companies and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) harmless from and against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this Contest or in any Contest-related activity including preparing for and traveling to any Prize-related activity. No prize shall be awarded unless the proposed winner shows valid U.S. issued Identification and completes, signs and returns an Affidavit of Eligibility, an Affidavit that all information included in the Nomination Answers is true and correct, a Liability Release, Tax Forms and (where legal) a Publicity Release. If required forms are not received by the date listed on the notification, or if a proposed winner is found to be ineligible or not in compliance with these Official Rules, if prize notification or prize is returned as undeliverable, or if a prize winner otherwise declines a prize, then the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate. Winner is responsible for any applicable taxes and will receive an IRS Form 1099 for any prizes. Released Parties are not responsible for mechanical, technical, human or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes or in any Contest-related materials. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right to suspend, modify or terminate the Contest and determine the potential winners from all eligible, non-suspect Nominations/entries received prior to such action using the judging procedure outlined above. The Grand Prize Winner must keep the Sponsor informed of any address changes.

    Any dispute, claim or controversy arising out of or relating to these Official Rules or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration before one (1) arbitrator. The arbitration shall be administered by JAMS Arbitration, Mediation and ADR Services (“JAMS”), 71 S. Wacker Drive, #3090, Chicago, Illinois, pursuant to JAMS’ Commercial Arbitration Rules and Procedures. Judgment on the Award may be entered exclusively either in Illinois state courts situated in Lake County, Illinois, or in federal courts situated in Cook County, Illinois. This clause shall not preclude the parties from seeking provisional remedies in aid of arbitration, but such actions shall be filed exclusively either in Illinois state courts situated in Lake County, Illinois, or in federal courts situated in Cook County, Illinois.

    To the extent permitted by law, each entrant agrees that: 1) any and all disputes, claims and causes of action arising out of or connected with this promotion or any prize awarded shall be resolved individually, without resort to any form of class action 2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and 3) no punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, “Special Damages”), and 4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.

    These Official Contest Rules shall be interpreted by the laws of the State of Illinois without regard to its conflicts of law provisions.
  7. WINNERS LIST: To obtain the names of the prizewinners (available after November 7th, 2019), send a self-addressed, stamped envelope to: “ELECTRICIAN OF THE YEAR” Answers Contest Winners, 450 Bond Street, Lincolnshire, IL 60069. Requests must be received by December 20th, 2019.
